TERMS & CONDITIONS

 

The purpose of these terms and conditions is to define the conditions and operating rules for training organised by the Centre de gestion pour la formation continue et professionnelle universitaire GIE, University of Luxembourg Competence Centre (hereinafter referred to as “the Competence Centre”). By signing the registration form for the targeted training, the participant acknowledges having read and accepted the terms and conditions of participation in the training of the Competence Centre set out below.

 

Article 1 – Training enrollment

Applicants wishing to participate in one of the training courses organised by the Competence Centre must apply online for enrollment via the website www.competence.lu.uat.competence.lu. The candidate will receive from the Competence Centre a registration file to complete and return signed by post or email to:

Article 2 – Admission to training and waiting list

Admission to the training is only effective after confirmation from the Competence Centre following receipt of the complete registration file and receipt of payment of the registration fees based on the invoice which will be sent to the participant or his employer. Depending on the case. If other admission criteria are applicable to the training targeted by the participant, these will be specified in the registration form.

However, if the Competence Centre and its partner(s) consider that the maximum number of registered participants has been reached, the Competence Centre reserves the right to refuse additional candidates. If the maximum number of candidates for the training is reached, the Competence Centre allows candidates wishing to continue training to register for free on a waiting list. If a space becomes available, this candidate is invited by email, either to register for the targeted training or to cancel their registration request. The vacated place is reserved for the candidate for a period of 7 calendar days. After this deadline, and without response from the said candidate, the vacant place is offered to the next candidate on the waiting list. If no space becomes available, registrations are kept on the waiting list until the next training.

Article 3 – Postponement or cancellation of training

For the organisation of the training, the registration of a minimum number of participants is required, this minimum number is assessed by the Competence Centre and, if applicable, its partner(s) according to the allocated budget. If the minimum number of registrations is not reached, the Competence Centre and its partner(s) reserve the right to postpone or cancel the training.

Article 4 – Payment of registration fees

The candidate or his employer is required to pay the training registration fees before the date indicated on the invoice sent to him by the Competence Centre, penalty for not being able to participate in the training. The candidate may nevertheless benefit from a payment installment, upon prior request made to the Competence Centre and express agreement of the Competence Centre.

Article 5 – Abandonment of training

A participant abandoning the training must notify the Competence Centre in writing at the above address. As of the registration request, the candidate has a withdrawal period of 14 days to cancel his registration at no cost, provided that the training has not started.

After this period of 14 days, the Competence Centre reserves the right to invoice as cancellation costs:

  • 30% of the registration fee if the abandonment is notified less than 8 days before the start of the training
  • 100% of the registration fee if the abandonment is notified on the start day or after the start of the training

Any training cycle started will be subject to payment of the full registration fee. Thus, an abandonment on the 1st day of training or during training will not give rise to any refund, neither total nor partial.

Regardless of the withdrawal period or the clauses related to the cancellation costs indicated above, and exceptionally, in certain (unexpected) cases of force majeure duly justified and documented (serious illness, accident, etc.), the Competence Centre may, at its full discretion, proceed with the partial or full reimbursement of registration fees.

Article 6 – Refund of registration fees

In case of cancellation of the training by the Competence Centre and its partner(s), the registration fees will be fully reimbursed to each participant or his employer. The decisions taken on this topic by the Competence Centre as well as the partners are final and without any motivation.

In addition to the cancellation of a training by the Competence Centre and the partner(s) or the cases of abandonment of the training by a participant as referred to in article 5 above, no refund of the paid registration fees is made.

Article 7 – Access to the educational platform

Six months after the last day of training, the Competence Centre reserves the right to archive the training, which may result in the cancellation of access to said training. If, after this period, the participant wishes to obtain the documents present in this space, he must contact the team in charge of the training.

Article 8 – Documents produced as part of the training

As part of the training follow-up and the obtaining of the certificate referred to in article 12 below, documents are produced both by the candidates and by the partners and by the Competence Centre, namely any presentation, any diagram, any original conceptualization and, in general, any work carried out within the framework of exercises or work at the end of training – this list being non-limiting.

The documents produced by the partner(s) and/or the Competence Centre remain the exclusive property of the latter, the candidate cannot use these documents for purposes other than in the strict context of the training.

All the elements constituting the copyright linked to the documents produced by the candidates either alone or in collaboration with the partner(s) and/or the Competence Centre are transferred to the partner(s) and to the Competence Centre. However, the candidate concerned also retains the right to consult, reproduce and use said documents.

Article 9 – Place of training

The Competence Centre reserves the right to change the location of the training sessions, for any reason it considers relevant, including logistics, for one or more sessions. If the location of the training sessions is changed, participants will be informed in advance.

Parking costs are not covered by the Competence Centre.

Article 10 – Attestation of presence

Attendance is compulsory and a certificate of attendance will be given at the end of the training. To this end, participants must sign up an attendance list during each course.

These attendance lists will give rise to the establishment of a certificate of attendance which will be given to participants providing that they have been present at a minimum of 80% of the training.

On the last day of each training session, the Competence Centre will ask participants to complete a survey to assess the quality of the content of the training delivered, the technical competence and pedagogy of the trainer as well as the logistical environment of the training.

Article 11 – Knowledge control and professional project

In order to guarantee the value of the certificates issued by the Competence Centre and its partner(s) at the end of the training courses offered, and this according to the specific characteristics inherent in each of the different training courses, a knowledge evaluation of each of the participants may be carried out through different evaluation tests and/or professional projects. More detailed information on the assessment tests and, if applicable, on the professional project is provided in the registration form.

In any event, in order to be able to take the final evaluation test, the participant must be present for a minimum of training hours. The minimum presence percentage is defined by the Competence Centre in article 10 above.

Article 12 – Certification

In the event that a knowledge evaluation is carried out as part of the training followed, success in the evaluation tests and/or the success of the professional project inherent in each training gives the right to a certificate issued jointly by the Competence Centre and its partner(s). Only modules validated by one or more test(s) will appear on the certificate. The certificate will include a mention according to the final grade:

  • From 0 to 10: Insufficient
  • From 10.1 to 12: Satisfactory
  • From 12.1 to 14: Good
  • From 14.1 to 16: Very Good
  • Above 16: Excellent

 

Article 13 – Processing of personal data

The Competence Centre is responsible for the processing of personal data communicated to it by the candidates when registering for a course. This personal data is processed in accordance with the general data protection regulations (hereinafter GDPR), the applicable legal and/or regulatory provisions in force and the general conditions for participation in training at the Competence Centre.

13.1. Types of personal data and purpose of processing personal data

The personal data collected is that which has been supplied to the Competence Centre by the candidate via the registration form and the complete registration file.

In addition to these data, the Competence Centre records attendances at training, results in tests, exams or professional projects as well as the certificates obtained and all correspondence exchanged with each participant. The processing of this data is carried out for the organisation, administration and management of the relevant training and exams, as well as for the establishment and sending of the certificate of participation or success in training.

13.2. Legal basis for processing

The processing of your personal data is based on article 6.1.b. (performance of a contract), article 6.1.e. (public interest mission of the controller) and article 6.1.f. (legitimate interest of the controller) of EU regulation 2016/679.

13.3. Communication of data to third parties

The training participant is informed that the necessary data may be communicated to persons external to the Competence Centre, to partner institutions or companies as well as to trainers within the framework of training organisation.

13.4. Data retention period

With reference to articles 7 and 8 of these terms and conditions, the documents produced by the participants during the training sessions as well as copies of the attendance certificates issued to the participants are kept for a period of 3 years by the Competence Centre. Certificates and/or diplomas are kept for life.

13.5. Rights of candidates / participants in training

Right of access:

In terms of data protection, the participant has the possibility of exercising a right of access. This right of access takes the form of a written request to the Competence Centre via the address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

The Competence Centre communicates to the participant a statement of the personal data at its disposal with the precision of the purpose, the duration of data conservation, and if necessary with the precision of the source of the data and that of a possible transfer to a third.

Right of rectification:

The participant has the right to request that inaccurate data concerning him be subject to correction. Such a request must be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

Right to erasure:

The participant has the right to request the erasure of data concerning him in the following cases:

  • if the latter considers that these data is no longer necessary regarding the purpose(s) for which they were collected and/or processed
  • if the processing of data is based on the sole consent of the participant and this consent is withdrawn
  • if the participant justifiably exercises his right of objection for a reason related to his particular situation and the Competence Centre has no compelling legitimate reason to assert
  • if the participant considers that his personal data is processed unlawfully by the Competence Centre
  • if the participant’s data must be deleted in order to comply with a legal obligation to which the Competence Centre is subject to

The request of the candidate / participant should be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

For its part, the Competence Centre may oppose the participant’s request:

  • if the processing of personal data is necessary by the law
  • if the processing of personal data is carried out for scientific or historical research purposes or for statistical purposes when their erasure would risk making it impossible or seriously jeopardizing the achievement of the purposes of said processing
  • if the Competence Centre should need it for the purpose of exercising its legal rights

Right to limit the processing of personal data:

The participant has the right to request the limitation of processing in the following cases:

  • if the participant disputes the accuracy of his data, the limitation thus operating the time necessary to verify the accuracy of the data
  • if, in the event of unlawful processing, the participant himself opposes the erasure of his data, and alternatively requests the limitation of his data
  • if the Competence Centre no longer need their data but the participant needs it for the establishment, exercise or defense of his legal rights
  • if the participant has objected to the processing for a reason related to his specific situation, the time necessary to verify whether the legitimate grounds pursued by the Competence Centre prevail over those of the participant

The participant’s request must be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

Participant’s right to object to processing:

The participant has the right to object to the processing of his data for the following reasons:

  • for reasons related to its specific situation, unless the Competence Centre demonstrates that it has legitimate and compelling reasons for the processing of the data of the candidate / participant concerned which prevail over the interests of the candidate / participant or if the Competence Centre has the need in order to establish, exercise or defend his legal rights
  • if the processing is carried out for prospecting purposes by the Competence Centre

The request of the candidate / participant should be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

Participant’s right to withdraw consent:

When the processing of the participant’s personal data is based on the latter’s consent, the participant has the right to withdraw his consent at any time. The Competence Centre will cease all use of the participant’s personal data; the participant’s personal data will be destroyed.

The participant’s request must be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

Right to claim:

The participant has the right to lodge a complaint with the National Commission for Data Protection (CNPD);

Participant’s right to data portability:

When the processing of personal data is based on consent or is necessary for the possible performance of a contract concluded with the Competence Centre and the processing of data is carried out by the Competence Centre through automated processes, the participant has the right to receive personal data available to the Competence Centre in a structured, commonly used and machine-readable format, so that it can be transmitted to another data controller.

The participant may also request the Competence Centre to transmit his personal data directly to another data controller, providing that this is technically possible.

The participant’s request must be sent to the Competence Centre via the email address dpo@competence.lu, enclosing a copy of a valid identity document which will be destroyed as soon as the request has been processed.

Article 14 – Image rights

By accepting these terms and conditions, the participant authorises that photos personally identifying the participant can be used, in particular during the delivery of certificates or when published on the Competence Centre website or on the social networks used by the Competence Centre as well as various other Competence Centre publications.
